Terms & Conditions
These Terms and Conditions govern your use of the website and services offered by Dagopal Investments LLC, operating under the brand name Dagopal Automation ("Dagopal Automation," "we," "us," or "our").
1. Services
We provide business automation services that may include:
- AI-assisted messaging workflows
- Appointment booking and reminder automation
- Customer support intake and routing
- SMS, WhatsApp Business Platform, email, web form, calendar, and CRM integrations
- Staff notifications, follow-up workflows, and reporting
Final service scope, pricing, timelines, and deliverables are defined in a separate proposal, invoice, statement of work, or written agreement when applicable.
2. Business Clients and End Users
Our clients are businesses that use automation to communicate with their own customers, patients, guests, or prospects. If you receive a message through a workflow we operate, the business you contacted remains responsible for its products, services, appointments, customer relationships, and legal obligations.
Dagopal Automation may provide technical infrastructure and support, but we do not impersonate our clients or claim to be the end business receiving the customer request.
3. Messaging Channels
Depending on the client setup, communications may occur through SMS, WhatsApp Business Platform, email, website forms, or other approved channels. Message frequency depends on the workflow and your interaction with the business.
Carrier message and data rates may apply for SMS or mobile messaging. You may request help or opt out where applicable. See our Messaging Policy for more detail.
4. Consent and Opt-Out
Business-initiated messaging should only occur when there is appropriate consent, user initiation, contractual necessity, or another legally valid basis. You may opt out of certain messaging workflows by following the opt-out instructions provided in the message or by contacting us or the relevant business.
5. Human Support and Automation Limits
Our systems may use artificial intelligence and automation to draft or send responses. Automated responses may be incomplete, delayed, or incorrect. For urgent, sensitive, medical, legal, financial, safety, or emergency matters, contact the relevant business, professional, emergency service, or qualified human representative directly.
6. Restricted Use Cases
Clients may not use our services for unlawful, deceptive, abusive, discriminatory, harmful, or unauthorized messaging. Some industries, including healthcare, financial services, legal services, regulated products, political activity, and emergency services, may require additional review, notices, permissions, or may be unsuitable for certain messaging channels.
7. Client Responsibilities
Business clients are responsible for:
- Providing accurate business information, pricing, policies, hours, and service details
- Obtaining required customer consents and permissions
- Complying with laws, platform rules, and industry requirements
- Reviewing automation behavior before and after launch
- Responding to customers when human review or escalation is needed
8. No Guaranteed Results
We aim to improve response speed, operational consistency, and workflow efficiency. We do not guarantee revenue growth, customer volume, appointment volume, deliverability, platform approval, account approval, or uninterrupted access to any third-party messaging platform.
9. Third-Party Platforms
Our services may rely on third-party tools and platforms, including messaging providers, AI providers, calendar tools, hosting platforms, CRM systems, and Meta/WhatsApp services. Those third parties have their own terms, policies, limits, and availability. We are not responsible for third-party outages, policy changes, account restrictions, or platform decisions.
10. Payments
Fees, billing terms, deposits, subscriptions, maintenance charges, and cancellation terms are defined in the applicable quote, invoice, or written agreement. Unless otherwise stated in writing, setup fees are charged for implementation work and are not automatically refundable after work begins.
11. Intellectual Property
We retain rights to our pre-existing tools, templates, methods, internal processes, and reusable automation logic. Clients retain rights to their own business names, logos, brand assets, customer data, and materials they provide to us.
12. Limitation of Liability
To the fullest extent permitted by law, Dagopal Investments LLC is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of our website, services, automations, third-party platforms, or messaging workflows.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the latest version. Continued use of our website or services after changes are posted means you accept the updated Terms.
